Texas ends double sales tax on third-party delivery orders for restaurants

Restaurants across Texas have been paying sales tax twice on third-party delivery orders, and as of this month, that’s over. Acting Comptroller Don Huffines signed an executive order eliminating the data processing fee that was being deducted from restaurant payouts after customers already paid tax on the full order. The Texas Restaurant Association says the change brings needed relief to businesses operating on thin margins.

The savings are concrete. Single-location independent restaurants expect to keep roughly $3,600 to $4,000 a year, while multi-unit locations estimate about $45,000. For Francisco Estrada and Lizzeth Martínez, co-owners of Naco Mexican, that’s meaningful breathing room. Estrada says third-party delivery currently works as a marketing tool rather than a profit center, and the savings arrive as the couple prepares to open Santonia Cantina at San Antonio’s Pearl. Local owners here in Waxahachie are running the same numbers, and every dollar that stays with a neighborhood kitchen tends to recirculate right here in town.

If you run a restaurant on the square or out along the highway, we’d like to hear how delivery has treated you. And if you’re a customer, we’ve got a question: do you order through the apps or call the restaurant directly? Let us know in the comments.
